Following notice contains the terms that govern sales of bags and accessories on www.corsiaitalia.com
The products purchased on the website www.corsiaitalia.com are produced, sold and identified by trademarks owned by Patrizia Montanari Enis s.r.l. a single shareholder, with registered offices in Ravenna (RA), Via Angelo Mariani, 11, registered with the Register of Companies of Ravenna, n. 218597, VAT IT02628120392, Share capital € 10.200,00  (The Corsia” or the “Seller” or “us”).

1. CONCLUSION OF SALE CONTRACT

1.1
These general sale terms  are an integral and essential part of the sales contract with the customer. The electronic sending of an order by the customer implies full knowledge of these General Conditions of Sale and their full acceptance. If the customer does not agree with any term contained in these Conditions of Sale is asked to refrain from making purchases on www.corsiaitalia.com (the “Site”).

1.2
To purchase one or more products on the site, the customer shall register on the Site, providing to Corsia, in compliance with applicable regulations regarding the protection of personal data, all the data necessary to enable Corsia to execute the orders placed.

1.3
To conclude his purchase contract with Corsia, the customer shall  send to Corsia his order following the procedure on the Site. The electronic transmission of the order gives rise to an obligation for the customer to pay the price specified therein.

1.4
When the customer places an order will receive an e-mail from Corsia confirming the receipt of the order and the order itself: this e-mail does not constitute however automatic acceptance of the order.

1.5
Corsia reserves the right to refuse orders from clients with whom there is an ongoing dispute concerning payment of a previous order.

2. SALES PRICES

2.1
All sales prices of the products shown on the Site are inclusive of VAT and all other taxes that may be applicable in connection with the sale.

2.2
The cost of shipping and handling, if applicable, will be clearly indicated and displayed before completion of the order.

2.3
Product prices may be subject to change. The customer shall ascertain the final price of sale before sending the order. The obvious error of price reported on the site compared to the price of the chosen product commonly known, implies the possibility for Corsia of not confirming the shipment and proceed with an immediate refund of the value of the purchase paid by the customer without any objection from the latter.

3. DELIVERY METHODS

3.1
Corsia will do its utmost to send the orders within 7 working days and no later than 30 days from the day following that on which the client has sent the order.

3.2
The customer is required to verify, upon receipt, the conformity of the product delivered to him with the order made; the customer must sign the documents received only thereafter, unless of course the right of withdrawal in paragraph 7,. Filling the registration form necessary for the execution of this contract and the following communications, the customer authorizes Corsia to communicate his personal data (address and telephone number) to carriers and / or forwarding agents used for delivery of the goods purchased.

4. TERMS OF PAYMENT

4.1
The customer can choose one of the procedures indicated on the order form. In no case they will be charged additional costs in relation to the payment instrument chosen.

4.2
In case of credit cards payment, it will be processed via secure connection directly to the bank owner and operator of the online payment service, which can not be accessed by Corsia. Financial information (for example,  number of credit card / debit card or expiration date) will be sent by encrypted protocol to Banca Sella or other banks which provide electronic payment services without any third parties access. Information will never be used by Corsia except for the purchase  procedures or for issuing refunds of products returns, in exercising the right of withdrawal, or for preventing or reporting to police fraud on the site.
The order amount will be charged at the time of bank transaction unless, of course, the customer claims of being credited back the amount in the event of any default by the Seller or failure to perform the contract for any reason.

4.3
The customer is solely responsible for the data entered so he guarantees to use only credit cards which he can legitimately use.

4.4
If the customer has a credit card account on  Paypal, the system will  save a recognition code for automatic credentials in future payments. In this case, the data will be collected by Corsia encrypted and transmitted to PayPal.

4.5
The customer can make payment by bank transfer only on the bank listed in the appropriate drop-down menu on the site. Otherwise, he cannot proceed with this payment method.

5. LIABILITY

5.1
Corsia shall not be held responsible for inefficiency caused by force majeure such as, for example, accidents, explosions, fires, strikes and / or lockouts, earthquakes, floods and other events that could prevent, in whole or in part, to carry out the contract within the agreed time.

5.2
Corsia shall not be held responsible for damages to any party or third parties for damages, losses and costs incurred in  case of contract fulfillment failure for the reasons mentioned above, the customer is only entitled to a refund of the paid price.

5.3
Corsia shall not be held responsible for any third parties fraudulent or illegal use of credit cards, checks or other payment methods. Corsia at no step of the purchase procedure is able to know the number of customers credit card  which are transmitted directly to the manager of bank service through a secure connection.

5.4
The essential characteristics of products are shown on the site on each product. The images and colors of products offered for sale may not exactly correspond to the real effect of the Internet browser or monitor used.

6. CUSTOMER’S OBLIGATIONS

6.1
It is strictly  forbidden to minors to conclude an order on the Site.

6.2
The data entered for the purchase shall be the only real personal data and not some other person, or fantasy data. Corsia reserves the right to prosecute any violation or abuse for all consumers protection.

6.3
Corsia shall not be held responsible for incorrect tax records because of errors made by the customer, being himself solely responsible for the correct entry.

7. RIGHT OF WITHDRAWAL AND REFUNDS

7.1
The client can exercise the right of withdrawal and return the product received, without penalty and explanation, in accordance with the terms and conditions hereunder.

7.2
The customer may download the return form on the site  following the procedure indicated – or by other clear communication of its decision to terminate the contract – within fourteen (14) days from receipt of goods.

7.3
Products has to be returned intact, unwashed, unused, undamaged and equipped with the tags indicating any bar code and any other seal that is part of the products; Products that are returned incomplete, damaged, corrupted, damaged or dirty will not be refunded.

7.4
The products to return has to be delivered to the shipper within fourteen (14) days from the day the Seller has been informed of its decision to terminate the contract.

7.5
The return costs will be paid by Corsia if the customer uses the pre-printed label that will find inside the package. This procedure will allow Corsia to pay the costs of returning  and to check at any time the location of the parcel. If the customer decides to use a different shipper, the shipping costs and liability in case of loss or damage of products will be his liability.

7.6
When receiving the products, the Seller shall check the conformity at the conditions specified in this paragraph.

7.7
If the right of withdrawal is exercised in conformity with the procedures and regulations specified in this paragraph, Corsia will refund the customer for any amounts paid for the purchase of products.

7.8
Whatever the mode of payment used by the customer, Corsia will provide for the refund as soon as possible and no later than fourteen (14) days from the date the Seller has been informed of the right of withdrawal, after verifying the correct return procedures and returned products.

7.9
Corsia usually refunds using the same payment mean used by the customer for the purchase of the returned products. In case the customer has used a temporary credit card or in case the credit card has expired or is expiring, the customer may send an email to info@corsiaitalia.com to agree on the most appropriate payment mean.

8. GOVERNING LAW AND JURISDICTION

8.1
Any dispute relating to application, execution, interpretation and violation of purchasing contracts concluded via the website www.corsiaitalia.com is subject to Italian law; the general conditions are reported, although not expressly, on the rules of the Civil Code and Legislative Decree no. 205/06 (“Consumer Code”). It is expressly excluded the application of the United Nations Convention on International Sale contracts.

8.2
Any dispute between the parties relating to this contract shall be at the court of the consumer’s domicile; all other disputes shall be at the Court of Ravenna.

9. CHANGES AND UPDATES

9.1
Lane reserves the right to modify the Site, policies and these Terms of Sale at any time to offer new products or services or to comply with law or regulations. The customer entering the website and placing an order will adhere to the policies and terms of the General Conditions of Sale in force when the order is made, except for changes which have retroactive effect under the applicable law ( in this case they will be  apply to previous orders too). In case any part of these Conditions is held invalid, void or for any reason unenforceable, that condition does not however affect the validity and enforceability of other terms.

As a consumer, you have legal rights to:
• Change your mind and withdraw from the sale contract with ENIS s.r.l. (the “Vendor”) for any reason and without incurring any penalty within fourteen (14) days from the date on which you received the products purchased from corsiaitalia.com. See section 1 below, including the exceptions to this right; or
• reject products in certain circumstances, for example because they are faulty or not as described. If so, you shall notify the Vendor within thirty (30) days of receipt using the online Return Form on the website; if a product becomes faulty after the thirty (30) days please contact Help before returning any product to us.

1. Right of withdrawal

You can exercise your right to withdraw from a contract between you and the Vendor within fourteen (14) days from the date on which you receive the relevant products by using one of the following methods:
1. a) Online submission to the Vendor of the Return Form found in the Help area, completed in its entirety; in this instance, the Vendor will send you an e-mail confirming that the Vendor has received your return request.
2. b) Sending to the Vendor this form to be completed in its entirety. This form must be submitted by email or by post to ENIS s.r.l. via Angelo Mariani, 11 48121 Ravenna Italy.
3. c) Make any other clear statement to the Vendor setting out your decision to withdraw from the contract.
Once you have exercised your right to withdraw from the sale contract, you must return the products to the Vendor without undue delay and in any event not later than fourteen (14) days after the day on which you notified the Vendor of your decision to withdraw. Please see section 2 below for details of your return options.
By law, it is not possible to exchange the chosen product(s) for other products.However, if you request an exchange, we may exchange the products you have returned for alternative products that you have requested, on a goodwill basis and in accordance with our Exchange Policy which is set out in section 5 below.

2. Procedure for returning products to the Vendor

The Vendor recommends you use the courier DHL (www.logistics.dhl/it-it/home.html) or GLS (www.gls-italy.com/) for returning products. If you use DHL or GLS and the pre-printed label – which carries the return address – enclosed in the original order, you will not have to pay the return costs upfront. The Vendor will pay the courier on your behalf and (except where you are exercising your legal rights to reject products – for example because they are faulty or not as described) will deduct from your refund a fee which is equal to the cost incurred for delivering the purchased products to your home. Contact UPS or GLS to organize a return. The possibility of tracking each package sent at any time using this shipping method relieves you from any responsibility for loss or damage to the products during transit.
If you decide to return products using a courier other than UPS, you will have to pay the return shipping costs upfront. In this event, you will also be refunded an amount equal to the standard shipping cost of the purchased products although you will not be refunded for any additional costs incurred due to choosing another kind of shipment and delivery that is different to or faster than the standard method.

3. Compliance checks for returned product(s)

You will be notified if the returned products cannot be accepted because they are not compliant with the conditions indicated above. If so, you can choose, at your own expense, to have the products returned to you. If you do not wish to have the products returned to you, the Vendor shall retain the products and the amount paid for the purchase of the products.
We also remind you that, when exercising your right of withdrawal in accordance with section 1 above, you will be liable for any decrease in value of the products returned to the Vendor resulting from any handling of them other than what is necessary to verify their nature, characteristics and functioning. The Vendor may reduce your refund to reflect such decrease in value, up to the total amount you paid for the relevant product(s).

4. Refund times and procedures

If you are entitled to return products to the Vendor and have complied with the conditions set out in this Return Policy, you will receive an e-mail confirming that the return has been accepted (which will include the amount of refund due) and the Vendor will process the refund. The refunded amount will be the full amount you paid for the relevant products, subject to any deductions in accordance with section 2.
Whatever the form of payment used, the Vendor will process the refund as quickly as possible and, in any case, within fourteen (14) days from the date it was informed of your decision to exercise your right to return, and once it has checked that the return was carried out in compliance with the above conditions.
The time period for refunding the amount paid for purchasing the returned products depends on the form of payment used:
• Purchase by credit/debit card: refund time will depend on the card company, but will normally take place within two billing cycles. The credit’s value date will be the same as the original debit. You will not, therefore, suffer any losses in terms of bank interest.
• Payment by PayPal: refunds will be credited to your PayPal account and will be visible immediately. The actual reimbursement of the credit card associated with your PayPal account will depend on the company that issued the card.
• Payment made by cash on delivery (if available): we will refund to the bank account indicated by you, so the time taken for the refund will depend on the accuracy of the information provided by you; the refund will usually take thirty (30) days.
In the case of gifts, the refund of the sums paid for purchases will be made to the individual who made the payment.

5. Identification Tag

We remind you that all products sold by the Vendor include an identification tag attached with a disposable seal which is an integral part of the product. Please try on the products without removing the tag and seal. Products returned without the tag and seal will not be accepted unless they are being returned by you in accordance with your legal rights to reject a product (for example, because a product is faulty or not as described).

2. How and why we process your personal data
The personal data we receive from our customers help us to personalize and improve your purchases on the site. We use this data, in particular, to manage your orders, provide products, process payments, communicate with you about orders, products, services and promotional offers, update our records and generally manage your account. We use this information also to improve our online shop and our platform, and to prevent or detect fraud or abuse of our website. The processing of personal data are carried out mainly through electronic and computer systems by CORSIA and by other subjects carrying out essential operations with purposes strictly related to the website and  to its services.

If you are paying by credit card, financial information (for example, the number of credit card / debit card or expiration date) will be sent by encrypted protocol to Banca Sella or other banks that provide services of remote electronic payment, without any third parties interference. Such data will be used by CORSIA exclusively for processing your purchase or issuing refunds in case of return of the products, exercising your right of withdrawal, or in case of fraud on www.corsiaitalia.com reporting to. The specific purposes for which the data are processed are summarized in the art. 13, d. Decree 196/2003, which will be presented when you release personal data in the various sections of our website.

We inform you that protection of personal data law allows CORSIA -without any obligation to obtain your prior consent – to use your data for direct selling activities involving products similar to those you have already purchased, unless you refuse such use. In this case, CORSIA will not use your information to send you advertising about its services and products unless you give yr. consent.

Your data will be communicated to third parties only with your express consent, except when it is required by law; in such case, the data will be available to third parties who will act independently and exclusively for such purpose (for example, in the case  it is requested by police or by courts or other competent authorities and  for example to fulfill obligations arising under the contract made with you).

Please note, finally, that your personal information will not be transferred abroad to countries other than EU countries, which do not provide a sufficient level of privacy protection. Should this be necessary to provide the services or to conclude a contract with CORSIA for the purchase of products, please be assured that the transfer of your personal data to countries that do not belong to the European Union and which do not ensure an adequate level of protection will be performed only upon specific agreement between  CORSIA and such entities in accordance with law and regulations.

In case CORSIA has to process personal data of third parties communicated directly by their users, for example if you purchased a product to be sent to a friend or when the person who pays the price for the purchase of the product is other than the person to whom it is sent. In these cases, CORSIA will make sure to send the third party notice under art. 13, d. Decree 196/2003 when recording the data, but you will be the one and only responsible to obtain the consent of the person to whom the data refer before communicating them to CORSIA.

3. Optional or compulsory communication of data
The provision in LANE policy when requested in several occasions of collection may be necessary to achieve the purposes specified in the proper information, or optional. The mandatory or optional nature of the data provision is specified each time – with reference to the specific data requested – at the single collection of data, putting an asterisk (*) the information that is required. Any refusal to communicate certain information marked as mandatory makes it impossible to achieve the main purpose of the specific collection and it may for example result in the inability to perform the contract for AISLE of purchase. CORSIA may uses third parties selected for their qualities of reliability.
Third parties responsible of data offer sufficient guarantees in full compliance with rules, including aspects of data security. These companies have been appointed as “controllers” and carry out their activities according to instructions from CORSIA and under its control.

2. Chiara Bassi – Web Designer for the data processing regarding management and maintenance of the site of CORSIA and marketing activities;

5. Your rights
You are entitled to obtain confirmation from CORSIA on yr. personal data. You are also entitled to obtain from CORSIA information about the origin of your personal data; the purposes and way of processing your personal data; the identity of the owner and data controllers; the names of individuals or categories of persons to whom the data may be communicated or who can learn about them as, for example, the data supervisors.
In addition, you have the right to obtain:
a) updating, correction, and integration of your personal data;
b) the cancellation, anonymization or blocking of your personal data in violation of the law, including data that need not be kept for the purposes for which the data were collected or subsequently processed;
c) confirmation that the operations in letters a) and b) have been notified, also as regards their content, to those in possession of yr. data, except in the case this may be impossible or involves disproportionate efforts compared to the protected right.

6. Safety measures
We take appropriate security measures in order to minimize the risk of destruction or loss – even accidental – of data, unauthorized access or treatment not allowed or inconsistent with the purposes as indicated in our Privacy Policy. However we can not guarantee that the measures taken limit or exclude any risk of unauthorized access or dispersion of data by user devices relevance. We recommend your computer is equipped with appropriate software to protect data transmission on the data network, both incoming and outgoing, and that your Internet service provider has taken appropriate measures for the security of the data transmission network.

7. Social Plug-ins
www.corsiaitalia.com uses  social plug-ins, buttons and features that let you share your favorite content on other sites (eg. the “likes” of Facebook). When you visit a page of our website and you interact with the plug-in (eg. by clicking “Like”), the corresponding information is transmitted from your browser directly to the platform of social networks (in this case Facebook) and there stored. This Privacy Policy is governed by Italian law and in particular by the Code regarding the protection of personal data (Legislative Decree 30 June 2003 no. 196) which regulates the processing of personal data by anyone who resides or has an office in Italy.
